Limitation of Liability and Disclaimer of Warranties
Bixa Beauty (“the company”) makes no warranties regarding the accuracy, completeness, or reliability of the site. The company assumes no liability for errors or omissions that may exist on the site.
The company also assumes no liability for any viruses, malware, or similarly destructive entities that may result from use of the site. We do aim to keep our site free of such entities, but in the case that they arise due to penetration of our security systems, we will not be liable for any damage that they may cause to your computer, data, or operating systems nor will we be liable for any costs of repair or replacement.
The company is not liable for any third party offers regarding our products and services. Products and services are provided on an “as is” and “as available” basis. Bixa Beauty disclaims all warranties, including but not limited to warranties of fitness for particular purpose, merchantability, non-infringement of third party rights, and title.
The company will not be liable for any damages that are a result of the use of the site, the inability to use the site, or loss of data based on any available legal theory, including but not limited to contract, warranty, or tort. This applies even in the case that the company has been advised of possible damages. Payments and Ordering
Payment We may pre-authorize charges to your card upon receipt of an order, though typically they will be debited upon preparation of shipment. By submitting an order, you guarantee that you have the funds available to complete the purchase. We are not responsible for denial of charges by your bank or credit card company.
Confirmation. Confirmation of your order by email does not necessarily indicate that we are able to complete an order. We reserve the right to modify orders prior to shipment due to the availability of products or other limitations. We will notify you by email if your order has been modified.
Shipping. Shipping charges are separate from the prices of products listed on the site. We will provide you with an assessment of shipping charges when you check out.
Descriptions While we strive to accurately describe our products accurately, we do not warrant that our descriptions are free of error or omission. If you believe your purchase differs significantly from what was described on the site, please see our return policy as well as information provided in the terms and conditions below.
Resale You may not sell, resell, duplicate, or otherwise use the products purchased on this site for personal profit. These products are intended for personal use by the purchaser or recipients of gifts given by the purchaser.
Delivery
We typically provide you with a delivery estimate provided by our shipping company when you check out. If your address is not accessible for delivery, we will notify you. This may be a result of a geographically remote location or local laws that prevent shipment to your address.
Force Majeure We assume no liability for deliveries that are delayed or not completed due to forces outside of our control, such as inclement weather, natural disaster, interruptions in labor, legal changes or any other issue that we could not reasonably foresee.
Returns and Exchanges
All items are final sale unless the product is damaged in transit or you receive the wrong product. In these cases, please contact us with your order number and address. We will initiate a replacement or exchange. We are not able to refund shipping charges. All returns will be processed within 10 days.
Accidental purchases may be reversed within one hour. If you do not initiate a reversal within one hour of checking out by contacting us at info@bixabeauty.com, the item(s) will be considered final sale.
Privacy and Security
Logins Accessing some portions of the site will require you to create an account. By creating an account, you certify that the required personal information is accurate. You will be able to update the information as necessary by logging in to your account.
Passwords Your account will require a password. You should store this password securely and refrain from sharing it with others. You may reset it through the settings in your account. Charges made to your account are your responsibility.
Third Party Affiliates The information you provide in the creation of your account is subject to our privacy policy, incorporated by reference into these terms and conditions. Termination
We may suspend or terminate this agreement, in part or in whole, at any time without notification. We may also restrict or terminate access to the site at any time without notification. This may occur as a result of your breach of these terms and conditions, such as fraudulent use or abusive behavior or for other reasons not specified here. Termination may include elimination of your account and secure destruction of your stored data. We accept no liability for doing so. Sections 1 and 6-11 of these terms and conditions shall survive termination. You will also remain liable for any outstanding charges.
Miscellaneous
Governing Law The company and the site operate in the State of Illinois. As such, the laws and statutes of the state will be the controlling laws and statutes applied to the company and site. By using the site, you agree to submit to the governing jurisdiction and venue of Illinois state courts in regards to matters that are controlled by this state. Any claims that are not eligible for hearing in small claims court will be resolved in state or federal court in Chicago, Illinois, where our business is based.
International Law We are happy to offer our products for worldwide shipment. However, we assume no liability in the case that our products are not legally permitted in your location or for taxation requirements that you are obligated to comply with under your local legislation. Products and services are void where prohibited. You agree not to export or re-export products if prohibited by export control laws.
Savings Clause If any portion of this agreement is not valid or is unenforceable, that portion shall be considered in terms of the closest applicable law that reflects its spirit and intent. The rest of the terms and conditions shall remain in force in that case. Failure on our part not to enforce or observe any portion of this agreement will not invalidate the remaining provisions.
Entire Agreement
This constitutes the entire agreement between the company and you, the customer. It supersedes any written or oral agreement between us. The agreement may not be transferred by you to another party and are not subject to alteration or amendment by you. The subheadings used in the agreement are provided for your convenience and do not have legal import. This agreement does not constitute anything resembling a partnership or joint venture between the company and yourself. If any material on the site is inconsistent with the terms and conditions, the terms and conditions will take precedence.
